TERMS AND CONDITIONS OF SALE

1. INTRODUCTION
These Terms and Conditions of Sale (“Terms”) govern:

Transactions made via SNOWPARD-operated physical retail stores (where applicable)

By placing an order, you confirm that you have read, understood, and agreed to these Terms along with our Privacy Policy and other applicable policies.
2. ELIGIBILITY AND USER REPRESENTATIONS
By using this website, you represent that:

You are legally competent to enter into binding contracts.

You are not purchasing products for unlawful resale or counterfeit distribution.

You will not misuse the website or its infrastructure.
We reserve the right to refuse service to anyone for violation of these Terms.
3. CONTRACT FORMATION
The process of order acceptance is as follows:

Order placed by customer.

Payment authorisation received.

Order acknowledgement email sent.

The contract is formed only upon dispatch confirmation.
An acknowledgement email does not constitute acceptance.
We may refuse or cancel orders for reasons including, but not limited to:

Pricing errors

Inventory errors
-
Suspected fraudulent transactions

Bulk/speculative purchasing
-
Abusive return history
-
Payment verification failure
If cancelled post-payment, a full refund will be issued.
4. ANTI-RESELLER AND BULK PURCHASE POLICY
SNOWPARD products are sold for personal use only.
We reserve the right to:

Cancel bulk orders that indicate resale intent.

Restrict customers from engaging in repeated high-volume purchases.
-
Block accounts involved in unauthorised resale or distribution.
Unauthorised resale of SNOWPARD products may result in legal action.
5. PRICING AND TAXATION

All prices displayed in India are inclusive of applicable GST.

International orders may exclude local import duties or taxes.
-
Customers are responsible for customs duties outside India.
We reserve the right to correct manifest pricing errors.
6. PAYMENT METHODS

Cash on Delivery (India only)

International cards and supported global gateways
Payments are subject to authorisation by the issuing financial institution.
We are not liable for gateway errors or banking delays.
7. CASH ON DELIVERY (COD) POLICY
COD is available on eligible Indian pincodes.
We reserve the right to:

Disable COD for high-risk regions

Restrict COD after repeated order rejections.

Suspend accounts with suspicious COD activity.
Repeated COD refusal may result in permanent restriction.
8. SHIPPING AND DELIVERY
We ship domestically and internationally.
Delivery timelines are estimates only and not guaranteed.
We are not liable for delays caused by:

Courier partners

Customs clearance

Government regulations
-
Natural disasters
-
Force majeure events
Risk transfers upon confirmed delivery.
9. INTERNATIONAL CUSTOMS AND IMPORT RESPONSIBILITY
For international shipments:

Import duties, VAT, customs charges, or clearance fees are the responsibility of the customer.

Refusal to pay customs may result in return-to-origin charges, which may be deducted from refunds.
10. RETURNS AND WITHDRAWAL POLICY (14 DAYS)
Customers may request a return within 14 days from delivery.
Conditions:

Unused, unworn, unwashed

Original tags intact

Original packaging maintained
Non-returnable items:

Innerwear (hygiene)

Gift cards
-
Final sale / discounted items

Customized products
Return shipping is borne by the customer unless the product is defective.
Refunds are issued after inspection to the original payment method.
Shipping fees are non-refundable.
We reserve the right to deny returns failing quality inspection.
11. RETURN ABUSE PROTECTION
We monitor return behaviour to protect against misuse.
We reserve the right to:

Refuse service to customers who have an excessive number of returns.

Charge restocking fees where legally permissible.

Suspend accounts abusing promotional returns.
12. DEFECTIVE PRODUCTS
If a product is defective:

Notify within 48 hours of delivery.

Provide clear photographic/video evidence.
Upon verification, we will:

Replace the item, or
-
Refund the purchase amount.
Shipping costs for verified defects are borne by SNOWPARD.
13. LOYALTY PROGRAM TERMS (IF APPLICABLE)
Any loyalty, rewards, or membership program offered by SNOWPARD:

May be modified or withdrawn at any time.
-
Points have no cash value.
-
Points are non-transferable.
-
Abuse may result in termination of membership.
Detailed loyalty terms shall be published separately.
14. INTELLECTUAL PROPERTY
All trademarks, product designs, artwork, content, photography, logos, and branding elements are the exclusive property of DEN OF SNOWPARD PVT LTD.
Unauthorised copying, replication, distribution, or commercial exploitation is strictly prohibited and enforceable under Indian intellectual property law and applicable international treaties.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law:

Our liability is limited to the purchase price of the product.

We shall not be liable for indirect, incidental, special, punitive, or consequential damages.

Nothing limits statutory rights under Indian Consumer Protection laws.
16. CHARGEBACK AND PAYMENT DISPUTES
In case of fraudulent chargebacks:

We reserve the right to submit transaction evidence to financial institutions.

Accounts involved in false chargebacks may be permanently restricted.
-
Legal recovery action may be initiated where necessary.
17. DATA PROTECTION AND PRIVACY
We process personal data in accordance with:

International customers’ data may be processed in India.

18. FORCE MAJEURE
We shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:

Natural disasters

War or civil unrest

Government restrictions
-
Pandemic events
-
Supply chain disruptions

Power or telecommunications failures
19. DISPUTE RESOLUTION AND ARBITRATION
All disputes shall first be attempted to be resolved through good-faith negotiation.
If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The decision shall be final and binding.
20. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India.
Subject to arbitration provisions, courts in Bengaluru, Karnataka, shall have exclusive jurisdiction.
21. SEVERABILITY
If any provision is held invalid, the remaining provisions remain enforceable.
22. MODIFICATIONS
We reserve the right to modify these Terms at any time. Continued use constitutes acceptance.
